Menurut <a href=\"https:\/\/mebiso.com\/wiki\/uu-merek-adalah-undang-undang-tentang-hak-indikasi-geografis-merek-terbaru\/\">Undang-Undang Merek <\/a>di Indonesia, merek dagang yang terdaftar akan mendapatkan hak eksklusif untuk menggunakan merek tersebut dalam kategori barang atau jasa tertentu.\u00a0<\/p>\n\n\n\n<p>Ini berarti, hanya pemilik merek yang terdaftar yang berhak secara hukum untuk menggunakan, menjual, atau melisensikan merek tersebut. Jika ada pihak lain yang mencoba menggunakan merek yang sama atau mirip, pemilik merek terdaftar dapat mengambil tindakan hukum untuk menghentikan pelanggaran tersebut dan menuntut ganti rugi.&nbsp;<\/p>\n\n\n\n<p>Selain itu, pendaftaran merek juga membantu dalam menghindari potensi sengketa hukum di masa depan, yang bisa mahal dan memakan waktu. Dengan mendaftarkan merek, pemilik bisnis juga membangun aset tak berwujud yang dapat meningkatkan nilai perusahaan dan memberikan daya saing di pasar.&nbsp;<\/p>\n\n\n\n<p>Pemerintah Indonesia melalui <a href=\"https:\/\/mebiso.com\/wiki\/djki\/\">Direktorat Jenderal Kekayaan Intelektual (DJKI)<\/a> juga mengharuskan pendaftaran merek sebagai langkah penting dalam mendukung perlindungan dan penegakan hak kekayaan intelektual di negara ini. Tanpa pendaftaran, perlindungan hukum terhadap merek dagang sangat terbatas, sehingga merek menjadi rentan terhadap pemalsuan dan eksploitasi oleh pihak lain.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-prinsip-perlindungan-merek\">Prinsip Perlindungan Merek<\/h2>\n\n\n\n<p>Prinsip perlindungan merek berdasarkan Undang-Undang Merek Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis mencakup beberapa aspek penting yang dirancang untuk memberikan perlindungan hukum yang kuat bagi pemilik merek.&nbsp;<\/p>\n\n\n\n<p>Pertama, ada prinsip pendaftaran, yang menyatakan bahwa perlindungan hukum terhadap merek diberikan kepada merek yang telah terdaftar di Direktorat Jenderal Kekayaan Intelektual. Ini berarti bahwa hanya merek yang terdaftar yang mendapatkan perlindungan eksklusif dari penggunaan tanpa izin oleh pihak lain.&nbsp;<\/p>\n\n\n\n<p>Kedua, ada prinsip <a href=\"https:\/\/mebiso.com\/wiki\/first-to-file\/\">first to file<\/a>, yang berarti bahwa hak atas merek diberikan kepada pihak yang pertama kali mengajukan pendaftaran, bukan kepada pihak yang pertama kali menggunakan merek tersebut.\u00a0<\/p>\n\n\n\n<p>Ketiga, prinsip kebaruan, yang mengharuskan merek yang didaftarkan haruslah baru dan tidak bertentangan dengan merek yang sudah ada.
